Declaration I hereby declare that all the information contained in this Audition Application (“Application”) is true and accurate without omission or concealment of any significant facts. I acknowledge that if I am hired by Beijing International Resort Co., Ltd. Theme Park and Resort Management Branch (“Company”), any omission, concealment or misrepresentation in this Application may become a sufficient condition for terminating my employment relationship with Company. I hereby authorize Company and its representative entities or individuals to verify the information in this Application. I personally will keep the information obtained in the process of audition, interview and recruitment strictly confidential. By signing on this Application, I confirm that I have voluntarily agreed to participate in auditions conducted by the Company, and I assume all risk of personal injury or property damage which may be incurred or caused by me. I hereby agree to hold the Company, and its respective managers, agents and employee free and harmless of and from loss, liability, damage, cost, or attorney’s fee incurred or caused by me. I further certify that I am over the age of eighteen (18) and in good health and physical condition."

Authorization for Background Check

I hereby authorize the Company and its representative(s) to verify all the information provided by or relating to me for audition and employment, and to conduct enquiries to relevant organizations and individuals as may be necessary. I unconditionally and irrevocably release the Company and its representative(s) from any liabilities for such use of the information. I hereby authorize all relevant organizations and /or individuals to disclose the information relating to me to the Company and its representative(s). I unconditionally and irrevocably release such organizations and/or person from any liabilities for such disclosure."

Personal Information Collection and Use Statement

I understand and agree to authorize that the Company and its affiliates (“Group Company”) may, for the purpose of communicating current and future employment opportunities, collect, process, store, share, access, and use my personal information contained in this Application and collected subject to authorization granted by me in this Application. For any personal information collected by the Group Company, the Group Company will retain it for a period of time after interview (only for achieving its original purpose or to meet time requirements by applicable laws and regulations). Personal information that is no longer needed or required will be destroyed, deleted or anonymized. The Group Company will take industry-standard security measures to maintain relevant process, technical and physical safeguards to avoid any loss, abuse, unauthorized access and alteration of such personal information. For the purpose of this Statement, “affiliate” in this Application refers to Beijing International Resort Co., Ltd, Universal (Beijing) Consulting Company Limited and their respective affiliates and subsidiaries."

Authorization Letter

In consideration of my participation in the audition held by Company, I hereby agree that:

1. I irrevocably grant to the Company the right to interview, photograph and record me, and to include my appearance, performance and interview into photos, sound recording, video or paper-media and multi-media recordings (collectively “Recording”). I unconditionally and irrevocably confirm that the Company owns all the Recording and all intellectual property rights and other rights in respect of my participation in the above-mentioned audition and interview, and I further agree that the Company owns the intellectual property and all other rights upon the Recording, containing my image or portrait, and voice, which include:
(a) the right to make copies of the Recording or any part thereof in any form and media;
(b) the right to issue to the public or release the Recording and its copies; the right to make available to the public by wire or wireless means (such as by Internet) copies of the Recording; (c) the right to play or show the Recording in public;
(d) the right to broadcast the Recording or to include it in a cable program; and
(e) to the extent permitted by applicable law, all other rights that may arise from the Recording.

2. I also unconditionally and irrevocably grant the Company and its affiliates the right to use, reproduce, broadcast, or otherwise make available to the public (including but not limited to, still camera photography and/or motion picture film or video tape or other Recording) my portrait and voice contained in the Recording referred in this Authorization Letter in all media throughout the world (whether now known or hereafter devised), without paying any compensation. The Company may also edit my appearance and voice as the Company at its sole discretion, may see fit.

3. The Company and its affiliates may, without paying any compensation, use (but nothing herein requires the Company to use) my name, voice, portrait, appearance, and autograph at any time and in any medium for “for profit” and “not-for-profit” use (including but not limited to promotion, marketing and business use), in connection with any theme parks/resorts, products, services, or attractions wholly or in part, directly or indirectly owned, operated, licensed or controlled by the Company and its affiliate (as defined above), as well as for internal publications, recruitment ads, Company websites/blogs and books.

4. I hereby release the Company and each of its affiliates from any and any and all claims, compensation, and causes of action which I may propose now or hereafter in connection with the exhibition of the Recording, my appearance or use of my portrait or voice.

5. I understand that any or all affiliates may be involved in the Recording and/or may tend to exercise the same rights as are granted to the Company under this Authorization Letter. I agree and explicitly consent and authorize that the Company may sub-license to any or all affiliates any and all rights granted to the Company under this Authorization, without my further individual consent for each sub-license."

This will confirm that I have voluntarily agreed to participate in auditions conducted by USJ LLC, an operating company of Universal Studios Japan. I acknowledge that in electing to participate in this activity, I do so freely, and I assume, for myself, all risk of personal injury or property damage, which I may suffer, incur, or cause. I hereby agree to hold USJ LLC, and its respective partners, officers, agents, and employees free and harmless of and from loss, liability, damage, cost, or attorney’s fees incurred by me or caused by me or caused by my participation in these auditions. I further certify that I am over the age of eighteen (18) and in good health and physical condition. I have acknowledged that any positions with USJ LLC, are within Japan and subject to applicable immigration screening and issuance of an appropriate visa to enter and work in Japan. To the best of my knowledge none of the following characteristics or restrictions applies to me or describes my background. I certify that I am not: • A person who has been sentenced to imprisonment or a graver punishment for one year or more in Japan or any other country, • A person who has been sentenced and punished for a crime under drug regulations in Japan or any other country, • A person who was rejected by Japanese government to enter in Japan within 1 year, • A person who was deported from Japan within one year, • A person who belongs to any political party or other entities which intends to destroy the Japanese government by violence, • A person who was deported from Japan because he/she belonged to a political party or other entities which intends to destroy the Japanese government by violence. I hereby agree to submit any documents (i.e. past experiences as an entertainer, 2 headshots) required when obtaining a visa in Japan, and that any contract with USJ LLC, will not be effective unless I am approved for issuance of an appropriate visa to enter Japan. I confirm that if I am under contract with a specific agent, I will submit a letter of approval to USJ LLC. I further agree to undergo a medical examination as may be required by USJ LLC. I certify that the information provided on this form is correct and complete to the best of my knowledge. I authorize USJ LLC, to seek information from past employers and other individuals for the purpose of verifying the information I have provided. I understand that any misstatements or omissions of material facts may be cause for my immediate dismissal. I understand any offer of a contract may be contingent on my successful completion of a physical examination as requested by the Company, and I authorize release of any medical information from doctors, hospitals, or insurance companies to USJ LLC, on my behalf. I release the Company and all providers of information from any liability as a result of furnishing or receiving information related to this application. I also understand that neither this form nor any communication by a management representative is intended to create or creates a contract of employment. I agree to conform to the rules and regulations of the Company and I understand such rules and regulations may be modified at any time the Company determines that it is necessary. I hereby authorize the Company to conduct an investigation which may include obtaining information covering references, character, past employment, contact former employers, work habits, education, general reputation, driving record, personal characteristics, mode of living, judgment, liens, and criminal background and to release the company, my former employers and others providing information, from all liability whatsoever resulting from the disclosure of such information. I hereby authorize you and your licensees to use my name and likeness and any and all video, audio recording or other submission submitted or otherwise provided by me to USJ LLC (“My Submission”) in connection with any advertising, publicity or commercial enterprise with which you may be connected, whether or not related to USJ LLC. By way of example, such exploitation may include my name and/or likeness in the manufacture, distribution and sale of pictures, postcards, albums and similar products. I hereby waive any right of inspection or approval and irrevocably release you and all other parties from any liability that may arise in connection with the use of My Submission. USJ LLC reserves the right to use any photograph, video and audio recordings for USJ LLC's own archival, promotional and research purposes, without the expressed written permission of those included in said recordings. By participating in the auditions conducted by USJ LLC, I am agreeing to release, defend, hold harmless and indemnify USJ LLC from any and all claims involving the use of My Submission.
